(j) Nondisclosure of Submitted Material. Except for an
agreement filed under section 5 of this Act, information and documentary
material filed with the Commission under section 5 or 6 is exempt from
disclosure under section 552 of title 5, United States Code and may not be
made public except as may be relevant to an administrative or judicial
action or proceeding. This section does not prevent disclosure to either
body of Congress or to a duly authorized committee or subcommittee of
Congress. (k) Representation. Upon notice to the Attorney General, the Commission may represent itself in district court proceedings under subsections (h) and (i) of this section and section 11(h) of this Act. With the approval of the Attorney General, the Commission may represent itself in proceedings in the United States Courts of Appeal under subsections (h) and (i) of this section and section 11(h) of this Act. SEC. 7. EXEMPTION FROM ANTITRUST LAWS (46 App. U.S.C. 1706 (2002)). (a) In General. The antitrust laws do not apply to_ (1) any agreement that has been filed under section 5 of this Act and is effective under section 5(d) or section 6, or is exempt under section 16 of this Act from any requirement of this Act; (2) any activity or agreement within the scope of this Act, whether permitted under or prohibited by this Act, undertaken or entered into with a reasonable basis to conclude that (A) it is pursuant to an agreement on file with the Commission and in effect when the activity took place, or (B) it is exempt under section 16 of this Act from any filing or publication requirement of this Act; |
